£27,500 Secured for Client for Japanese Knotweed Encroachment
We acted for a client located in London, who had suffered a large diminution in value to his property due to the encroachment of Japanese Knotweed stems from neighboring land.
The land is owned by a real estate development company, who had let the growth of the plant continue to spread and development onto our clients property boundaries.
We pursued a claim against the defendant who continued to deny liability of the plant, which led us to proceed and issue court proceedings.
After some negotiation, we were able to secure a settlement of £27,500 for our client.
In a separate agreement, we were able to arrange for the knotweed to be treated by a ‘PCA’ approved company, with the provision of a ten year insurance backed guarantee at the conclusion of the treatment.
This will ensure that future growth and treatment will continue since settling, which will provide the client with security and peace of mind.
Japanese Knotweed poses a diminution in value threat on ones land, therefore this extra guarantee will allow our client to sell his property (if required) without any value decrease imposed.
