Sick notes mishandled by NHS resulting in data breach claim win

Our client had recently come out of employment due to medical conditions and was in the process of requesting new sick notes from their GP in the Summer of 2020.

Our client was made aware verbally via telephone by the GP practice, that a serious data breach had occurred surround his personal medical details.

Both contact information and details of his medical conditions were exposed during the breach. Our clients anxiety levels were heightened as a result of this, alongside the insecurity the client felt about their sick note details being exposed to those other than close family and friends.

This data breach had all stemmed from a sick note being mis-handled at his NHS practice, which resulted in our client having little to no confidence in his GP practice of over 30 years.

This data breach claim continued to court, where a hearing took place with the defendant wanting to negotiate compensation for our client. We successfully negotiated a settlement sum of £1,500.
