Japanese Knotweed Settlement of £15,000.00 For Stockton-On-Tees Home Owner
Our client who lived in Stockton-On-Tees had instructed ourselves back in October 2018.
Our client had been complaining to Network Rail for some time before deciding to proceed with legal action. Once instructed we proceeded with a claim for private nuisance regarding the presence of the Japanese Knotweed KW on our clients land. The plant in question was located near the rear garden of our clients home. There was damages caused to the wall paving, which was caused by the knotweed encroachment from the defendants land.
After entering into settlement negotiations Angelus Law settled the clients claim for £15,000 pre-issue. The claimant has been paid damages in relation to the following 3 points:
- To treat the JKW on their land using a PCA approved company with an insurance backed guarantee.
- For the unlawful interference with the enjoyment of their property due to the presence of the JKW and;
- For the diminution of value of the property due to the presence of the JKW.
As per our settlement agreement with the Defendant, Network rail will also be carrying out treatment on their own land to fully treat and eradicate the Japanese Knotweed to prevent future encroachment. We ensure that a 10-year back guarantee is undertaken on all treatment to ensure the eradication process is fulfilled indefinitely.
Our client is very happy with the settlement arranged and now has some financial security when it concerns his home and future prospects. As Japanese Knotweed can have detrimental effects on the value of ones home.
